Terms of Service

These Terms of Service explain the rules that apply when you use the eSIMbag website, account features, eSIM package discovery, purchase, payment, digital delivery, and post-purchase support services.

1. Introduction

These Terms of Service (“Terms”) govern your use of the eSIMbag website, account features, eSIM package discovery, purchase, payment, digital delivery, eSIM management, and related support services operated by eSIMbag LLC.

In these Terms, “eSIMbag”, “we”, “us”, or “our” refers to eSIMbag LLC. “You” or “user” refers to the person using the Services.

By creating an account, using the website, selecting an eSIM package, creating an order, completing a payment, or continuing to use the Services, you agree to these Terms.

These Terms apply to individual customer use. Corporate, partnership, reseller, authorized management, or other business arrangements may be subject to separate written agreements and may fall outside the scope of these Terms.

2. About eSIMbag

eSIMbag is a digital travel connectivity platform that helps international travelers discover, compare, purchase, receive, and manage digital eSIM data packages for country, regional, or global coverage.

eSIMbag is operated by eSIMbag LLC, a company registered in Wyoming, United States.

3. Definitions

The following terms are used in these Terms:

  • Platform: the eSIMbag website, customer account areas, eSIM package discovery pages, order and payment flows, eSIM management screens, and related support features.
  • Services: eSIM package discovery, purchase, payment, digital delivery, eSIM management, and support services provided through the Platform.
  • User: a person using the Services for personal travel, business travel, or other permitted connectivity needs.
  • Account: a registered profile used to manage orders, eSIM information, and related account features.
  • eSIM: a digital mobile data profile that can be installed on compatible devices without a physical SIM card.
  • eSIM Package or Package: a digital eSIM data product with specified data, validity, coverage, country, regional, or global use characteristics.
  • Order: the purchase record created for the eSIM Package selected by a user.
  • Payment: the payment process used to complete an Order through third-party payment providers.
  • Digital Delivery: making the eSIM profile or installation/activation information available through a user account, order page, QR code, LPA information, or another supported digital method.
  • Third-Party Providers: payment providers, eSIM network/provisioning providers, local telecommunications operators, hosting/email providers, authentication providers, and other service providers used to provide the Services.

4. Eligibility and Age Requirement

You may use the Services only if you are at least 18 years old and have the legal capacity to enter into a binding agreement in your location.

If you use the Services on behalf of a company, organization, or another person, you represent that you have authority to bind that person or organization to these Terms.

When using the Services, you agree to comply with applicable local laws, telecommunications rules, sanctions and export control regulations, payment provider rules, and these Terms.

5. Account Registration and Account Security

You may need to create an account or sign in to use certain Services. Your account information must be accurate, current, and belong to you.

You are responsible for protecting your account credentials and notifying us without delay if you believe your account has been accessed or used without authorization.

Suspicious or unauthorized activity involving your account may be reviewed under applicable law, payment provider rules, security reviews, and relevant policies.

You may not create an account for another person without authorization, provide false identity information, or use the Services with false, misleading, or unauthorized information.

6. Scope of the Services

eSIMbag allows users to view, compare, purchase, pay for, digitally receive, and manage eSIM Packages by country, region, or global coverage.

The scope of the Services may change over time. Certain features, countries, packages, payment methods, device support, or coverage areas may not be available for every user, country, device, or account.

We do not guarantee that the Services will be available in every country, on every device, on every local network, or under all operator conditions without interruption or with the same quality.

7. eSIM Packages, Coverage, and Local Networks

eSIM Packages are digital mobile data products. Data allowance, validity period, coverage area, supported networks, speed, fair use conditions, and usage terms may vary depending on the package, provider, local operator, and destination.

Coverage information is provided to help users make an informed decision. Local network access may be affected by location, indoor use, terrain, network congestion, device model, device settings, roaming availability, and local operator restrictions.

eSIMbag does not guarantee that local telecommunications networks will be uninterrupted, error-free, available at the same speed, or accessible in every location.

Before purchasing, you are responsible for checking whether the selected package, country/region coverage, data allowance, validity period, device compatibility, and travel needs match your intended use.

8. Device Compatibility and User Responsibility

To use an eSIM, your device must support eSIM technology, be unlocked, be suitable for the relevant country or region, and meet the required software and configuration conditions.

Device compatibility may vary based on device model, manufacturing region, carrier lock status, operating system version, SIM/eSIM settings, roaming settings, and local regulations.

Before completing a purchase, you are responsible for confirming that your device supports eSIM and is suitable for the package you select.

Device incompatibility, carrier lock, incorrect device settings, disabled roaming settings, incorrect APN or installation steps, deletion of an eSIM profile from the device, or user-caused installation errors do not create a right to a refund.

9. Orders, Payment, and Pricing

When you select an eSIM Package and create an Order, the Order may not be processed until payment is completed. After payment is completed, digital delivery, provisioning, or order completion processes may begin.

Card payments and other supported payment methods are processed through third-party payment providers. eSIMbag does not store full card numbers or CVV codes on its own systems.

Prices are based on the amounts shown during the order or payment flow. Taxes, bank fees, card network fees, exchange rate differences, or international transaction fees may vary depending on your bank, card issuer, payment provider, or country.

eSIMbag may reject, suspend, or cancel an Order in cases of obvious system error, incorrect pricing, suspicious activity, payment risk, misuse, legal compliance requirements, or technical/operational reasons that prevent the Service from being provided.

If a payment is declined, failed, reversed, or not completed by the payment provider, eSIM delivery may not be provided.

10. Discounts, Coupons, and Promotions

eSIMbag may offer coupons, discount codes, campaigns, or promotions within the order or payment flow from time to time.

Coupons and discounts may be used only within the applicable time period, country, package, account, order, or campaign conditions.

Coupons, discounts, and promotions cannot be exchanged for cash, transferred, applied retroactively to past orders, or misused.

eSIMbag may reject, cancel, or limit a coupon, discount, or promotion in cases of technical error, obvious pricing or discount error, misuse, suspected fraud, unauthorized sharing, or breach of campaign conditions.

11. Digital Delivery, QR Codes, and Activation Information

eSIM Packages are not physical products. After purchase and payment are completed, eSIM information is provided digitally.

Digital Delivery may be made through a QR code, LPA information, ICCID, installation instructions, account page, email notification, or another supported digital method.

Digital Delivery does not mean that the eSIM has been successfully installed, activated, or will work uninterrupted on a local network. Installation and use depend on the device, settings, local network conditions, and provider processes.

QR codes, LPA information, and activation details may be specific to your order and account. You must not share, duplicate, or use this information without authorization.

Deleting an eSIM profile from your device, attempting to move it to another device, or using it contrary to the installation instructions may prevent the eSIM from being reinstalled or used.

12. Final Sale, Cancellation, and Refund Approach

eSIM Packages are digital products. Once payment is completed, the purchase is considered final sale and is non-refundable.

Changes to travel plans, selecting the wrong country/region/package, device incompatibility, carrier lock, local network quality, coverage differences, incorrect installation steps, deletion of the eSIM from the device, or choosing not to use the eSIM do not create a right to a refund.

For technical delivery, provisioning, installation, or usage issues, eSIMbag may try to provide support, review, redelivery, setup guidance, or another reasonable technical solution. This support process does not create a promise of a refund.

Duplicate charges, payment processing errors, or legally required payment corrections do not mean that the eSIM product itself is refundable. Such matters may be reviewed separately based on payment provider records, transaction history, and applicable law.

Nothing in this section limits mandatory consumer rights that cannot be excluded or limited by contract under applicable law.

13. Support and User Assistance

eSIMbag tries to assist users with reasonable support requests related to orders, payments, digital delivery, installation, and eSIM usage.

For support requests, we may ask for identity, account, order, device, payment, or installation information. This information is used to review your request and provide the Services.

Providing support does not guarantee a specific outcome, resolution of a local network issue, correction of device incompatibility, or a refund.

14. Acceptable Use

When using the Services, you must not:

  • Use the Services for unlawful, fraudulent, harmful, misleading, or unauthorized purposes.
  • Create accounts, place orders, or make payments on behalf of another person without authorization.
  • Sell, transfer, share, or commercially resell eSIM Packages, QR/LPA information, or account access without authorization.
  • Scrape the Platform, misuse it through automation, reverse engineer it, bypass security measures, or disrupt system integrity.
  • Misuse payment, chargeback, coupon, campaign, support, or dispute processes.
  • Provide false, misleading, incomplete, or fraudulent information.
  • Violate local telecommunications rules, sanctions/export control rules, or applicable laws.
  • Act in a way that harms the security, reputation, operations, providers, or other users of eSIMbag.

15. Service Access, Suspension, and Termination

eSIMbag tries to provide the Services securely, reliably, and properly; however, we do not guarantee that the Services will always be uninterrupted, error-free, or available in all regions.

Your access to the Services may be temporarily or permanently limited, suspended, or terminated in cases of maintenance, security risk, technical failure, provider outage, payment risk, legal compliance requirement, suspected misuse, or breach of these Terms.

We will try to provide notice where reasonable, but prior notice may not be possible in urgent situations involving security, legal compliance, payment risk, suspected fraud, or system integrity.

16. Third-Party Providers

To provide the Services, we may use payment providers, eSIM network/provisioning providers, local telecommunications operators, hosting/email providers, authentication providers, and other third-party service providers.

Third-party providers’ services, networks, systems, security controls, payment rules, outages, local coverage conditions, and own terms of use may be outside eSIMbag’s direct control.

Your use of or interaction with third-party services may be subject to the relevant provider’s own terms, policies, and technical requirements.

17. Intellectual Property

The eSIMbag name, logo, brand elements, website designs, text, interfaces, software, images, components, and other Platform-related content are owned by eSIMbag or its licensors.

These Terms grant you a limited, revocable, non-transferable, non-exclusive right to use the Services for personal and permitted purposes.

Nothing in the Services gives you ownership of eSIMbag trademarks, software, designs, or content.

18. Privacy and Data Protection

For information about how personal data is collected, used, stored, shared, and protected, please review our Privacy Policy.

For information about cookies and similar technologies, please review our Cookie Policy.

By using the Services, you acknowledge that your personal data may be processed in accordance with our applicable policies.

19. Disclaimers

To the maximum extent permitted by applicable law, the Services are provided “as is” and “as available”.

eSIMbag does not guarantee that local networks will operate without interruption, that coverage will exist in every location, that every device will be compatible, that every installation will succeed, or that the Services will always be error-free, uninterrupted, or fit for a particular purpose.

eSIMbag is not responsible for service interruptions, network quality, latency, restrictions, or errors caused by local operators, device manufacturers, payment providers, eSIM network/provisioning providers, or other third parties outside eSIMbag’s control.

Nothing in these Terms limits rights or liabilities that cannot be limited or excluded under applicable law.

20. Limitation of Liability

To the maximum extent permitted by applicable law, eSIMbag is not liable for indirect, incidental, special, punitive, or consequential damages, loss of profit, data loss, business interruption, travel plan changes, or damages arising from third-party services.

To the maximum extent permitted by applicable law, eSIMbag’s total liability for any claim is limited to the amount you actually paid to eSIMbag for the Order giving rise to the claim.

These limitations do not apply to mandatory consumer rights, intentional misconduct, gross negligence, death or personal injury, or other liabilities that cannot be excluded or limited under applicable law.

21. Indemnity

To the extent permitted by applicable law, you may be responsible for reasonable claims, damages, costs, and expenses brought against eSIMbag, its providers, officers, employees, or partners arising from your breach of these Terms, misuse of the Services, provision of false or unauthorized information, violation of third-party rights, or violation of applicable law.

22. International Use, Sanctions, and Local Law

eSIMbag is designed as a global digital service; however, we do not guarantee that the Services, specific packages, payment methods, or coverage areas will be available in every country or region.

You may not use the Services in a way that violates sanctions, export controls, telecommunications regulations, local data/communications rules, or other applicable laws.

You are responsible for complying with local rules in your location regarding eSIM use, roaming, mobile data access, and digital service purchases.

23. Changes to These Terms

eSIMbag may update these Terms from time to time. Updates may be made due to service changes, technical requirements, business operations, provider rules, legal requirements, or policy alignment.

For material changes, we may provide notice to the extent required by applicable law. Your continued use of the Services after updated Terms are published means that you accept the updated Terms.

24. Governing Law and Disputes

These Terms are governed by and interpreted under the laws of the State of Wyoming and the United States of America, excluding conflict of law rules.

Nothing in these Terms removes or limits mandatory consumer rights in your country of residence that cannot be excluded or limited by contract.

If a dispute arises, we encourage you to contact us first at support@esimbag.com. Disputes will be evaluated under applicable law and by the competent courts or authorities.
